Terms of Trade

These Terms of Trade apply to all goods supplied by Sun and Light Foods Pty Ltd (ABN 98 691 960 175), trading as Premium Poultry, to its trade customers. Please read them carefully. By placing an order with us, you agree to be bound by these terms.

1. Application

These terms apply to every order, sale, and supply of goods by Sun and Light Foods Pty Ltd (“the Supplier”, “we”, “us”, “our”) to the customer, unless otherwise agreed in writing.

2. Pricing

Prices are confirmed at the time of order via your sales rep. Prices are subject to change without notice and may vary based on volume, pack format, and market conditions. Quoted prices are valid for the period specified by your sales rep.

3. Orders and delivery

Orders should be placed with your sales rep by the cut-off time advised for your delivery area. Delivery times are estimates only; we will use reasonable efforts to deliver on time but accept no liability for delays caused by circumstances outside our control.

4. Payment

Payment terms are as agreed at account opening. Standard terms are net 7 days from invoice date unless otherwise specified. Overdue accounts may incur interest charges and supply may be suspended.

5. Title and risk

Title to goods passes to the customer on full payment of the invoice. Risk passes on delivery.

6. Returns and claims

Any claim regarding short-supply, damage, or product condition must be raised with your sales rep within 24 hours of delivery. Photographic evidence is required for damage claims.

7. Food safety

Customers are responsible for maintaining cold-chain integrity from the point of delivery. Our responsibility ends at the point goods are signed for at the customer’s premises.

8. Limitation of liability

To the extent permitted by law, our liability for any loss or damage is limited to the replacement value of the goods supplied. We exclude liability for indirect, consequential or economic loss.

9. Governing law

These terms are governed by the laws of Western Australia. Any dispute is subject to the exclusive jurisdiction of the courts of Western Australia.
